  Land acquisition and construction approval process

There are two ways of finding a suitable site for construction. The first one is to contact local municipality for getting information about free land sites for particular type of activities. However, the sites can be acquired only at auction, and the site should have detailed plan. Local municipalities usually lack financial resources available for detailed planning of free sites. That is why this process is rather slow in regional municipalities.

Another way is to contact local real estate agents or real estate developers for finding a privately owned land plots.

In both ways usage of the site should be documented according to the territory planning no matter what type of activities will be carried out on the site – industrial, commercial or residential.

Before starting activities in a site, it is necessary to make sure, that intended activity suits the purpose of land site. If planned activity doesn’t suit the purpose of land site, it is necessary to follow town or district detailed plan while preparing documents.

If intended activity is within the frames of the General plan, the purpose of a land site can be changed while preparing the detailed plan of the site.

The shortest term necessary for the preparation of the detailed plan for the site in accordance with legal requirements for the procedures is 6 months.

If intended activity is not suitable for the requirements of the General plan, it is necessary to apply to city or regional municipality council in order to make the necessary amendments to the General plan (the procedure may take approximately 12 months) and only then prepare the detailed plan.

In such cases when the intended activity complies with the purpose of the land site, the technical project of buildings is prepared. After completion and coordination of the technical project according to the requirements of the procedures, it is necessary to apply to the municipality administration for the permission of construction licence.

Site developer should also execute environmental impact assessment. This is subject to almost all types of industrial activities. This procedure can be done at the same time with detailed planning process.

The whole process before the beginning of construction takes from 6 months up to 18 months.

It is recommended to subcontract construction or architecture company to prepare all the necessary documentation and to control the construction process.

For the construction process developer should contract a general contractor, which will subcontract different companies for the execution of particular construction works. The building should be inspected by the construction inspection, Fire Protection Dept. (under County Governor’s Administration) and other responsible bodies in order to get the permission for exploitation of the premises.

After getting the permission, premises should be registered in the Register Centre.
